Peru: obligation to hire a social worker repealed

On June 14th, the Supreme Decree Nº 009-65-TR, a 1965 regulation mandating the employment of a qualified social worker, was repealed in Peru. Consequently, companies with over 100 employees previously affected by this legislation are no longer required to have a social worker within their 'Industrial Relations' department. 

Context and function 

The welfare of employees was the primary objective behind the implementation of this decree. Its function was to assist workers with issues such as psychosocial risks, complex family problems, and intermediation for social benefits. As an obligation, non-compliance fines were also stipulated for companies without a social worker on staff, though this penalty was introduced in 2006. 

Repeal of the law 

Through Supreme Decree N° 005-2025-TR, both the regulation and the economic penalty have been annulled in favor of private entities. The repeal of the legislation stems from the Peruvian state's practices being classified as "bureaucratic barriers declared illegal and/or lacking reasonableness", as stated in the publication of June 14. 

Conclusions 

This measure eases the legal burden on companies in Peru, especially those impacted by this decades-old law. Therefore, while it remains an option for companies in Peru, it is no longer a mandatory obligation.
