In Italy, the new Legislative Decree 138/2024 adapts the EU NIS 2 Directive to the Italian legal system. With some main challenges companies will face in complying with the new regulation. The key decisions that will need to be taken in the coming months are highlighted as the ACN (Agenzia per la Cybersicurezza Nazionale) defines the implementation process.

What does this rule consist of?

The NIS 2 Directive aims to update cybersecurity regulations to strengthen the protection of critical digital infrastructures in Italy and Europe. It extends security requirements to sectors such as energy, transport, health, and digital services, and is designed to strengthen cooperation between member countries to improve cyber incident response.

Objectives from the measure

Among the most significant changes introduced by the NIS 2 Directive are increased security requirements for companies‘ technology systems and improved procedures for reporting cybersecurity incidents. It also places a more rigorous emphasis on cyber risk management, obliging organizations to implement clear policies and have the necessary resources in place to mitigate these risks. In this context, the public entities stress that cybersecurity should be considered not only as a technical responsibility, but also a strategic pillar within corporate governance.

Furthermore, the need for companies to adequately prepare to comply with the new requirements is highlighted. Moreover, both private and public organizations must promote collaboration between the private sector and government authorities. The NIS 2 Directive aims not only to protect critical infrastructures, but also to foster a more secure digital environment across the European region.
