The Peruvian Republic Congress approved Law Nº 30312, published on the 22nd of March in the Official Paper “El Peruano”; this law confirms the Agreement 183, from the International Labour Organization concerning the maternity protection.

The agreement states “minimum 14 weeks (98 days) of maternity leave” and prohibited the possibility of dismissals during the pregnancy period and birth date for all those countries which subscribe the Agreement.

It should be notice that Peru currently has a maternity leave of 90 days (12.8 weeks). The new law increase the period within 8 extra days.

Also, this Agreement states that any woman cannot be forced to present any medical exam to prove if she is pregnant when she would apply to a job placement.

Finally, the Agreement will be in force 12 months, after the Member State ratification, so in Peru will comply from March 2016.
