    • 07/04/2010 NEW HORIZONS: ACCACIA/AUXADI IN CHINA

      Chinese Desk. Partner in China.

      • As part of our strategy for 2010, and bearing in mind to expand our BPO professional firms’ network (ACCACIA), in order to provide our international clients with greater and better solutions, Auxadi is entering into the Middle East, focusing in the Chinese market.

China is one of the most emerging countries nowadays, and one of the biggest scenarios for current investments.

As we are all aware, China has gone through a huge economic growth during the last decades, and its current growth rate forecast for this year 2010 goes up to a 16%.

While for many years it has been considered as a source of cheap labour, the point is that foreign companies regard this country as a feasible market, more and more now when the profits would be taxed at a 15% against the high tax rates applied to other countries (such as the United States, Spain, and so on).

In addition, another fact to boost the foreign investment strengthening in China is the low unemployment rate (hardly a 4%) and with and inflation rate of just 5%.

Given all the above and as a consequence of the increasing foreign growth experienced by this country for the last years, it emerged the need to train professionals capable to have a global vision of the business opportunities that the foreign investment in China may offer.

As a result of an agreement between the European Commission and the Chinese Government, and managed by a Chinese and European university consortium, the China-EU School of Law (CESL) in Beijing has founded a program focused to train foreign law professionals, contributing to the modernization of the Chinese juridical institutions and to the complete introduction of the rule of law in that country, together with the goal of strengthening the relationships between European and Chinese professionals and academicians.

This year 2010, the public company PromoMadrid Desarrollo Internacional de Madrid, S.A. (in charge of the international promotion and development of the Comunidad de Madrid from an economic standpoint) and the Facultad de Derecho de la Universidad Autónoma de Madrid, have awarded 8 grants to lawyers having experience in the field of foreign investments in Spain to participate into a Course named “Relevant Fields in Chinese Law for European Foreign Investment in China” during this month of April in the China-Eu School of Law (CESL) in Beijing.

Among the more than 200 applicants, our workmate Lorena Salamanca has been one of these 8 professionals elected to represent Spain in this event, under the grant regime and with all expenses covered.

The program is focused to European lawyers, offering a global view of the institutional juridical frame of the market economy in China. The course will analyse the recent legal reforms, the settlement of foreign entities in China, the labour relationships, the tax regulations for companies with foreign investment, problems resolution, ownership protection and technology transfer, inter alia. It will combine the conferences with visits to public organisms of the Chinese State playing and important role in the institutional sphere of the foreign investment in China.

Making the most of this grant, and of the visit to China, Auxadi’s Executive Board has asked Lorena to make an analysis to determine the feasibility to set up, in a near future, a service line additional to our Legal Department (the Chinese Desk).

The final goal of this Chinese Desk would be the possibility to provide to those Spanish clients interested to settle down in China with the required advice. In order to do so, Auxadi would count with a local Partner to assist our potential clients, and vice versa.

Lorena’s analysis would also be useful to Accacia.

Although not included within the action plan for 2010, Accacia strongly approves Auxadi’s initiative, undertaking an analysis of potential firms interested in being part of our association in a near future as our Chinese representative.

In this sense, the first contacts with some Chinese firms have been made and a meeting calendar for Lorena in Beijing and, if needed, in Hong Kong, has also been drafted.

We expect our experience in China to be the most fruitful possible, showing the services we render, to other professionals in our area, and trying to come back with a possible collaboration with any of them.

We will keep on informing you about this and other initiatives that we are planning to launch.
